The Pond Jumper — Effective date: 1 November 2026

1. About us

The Pond Jumper is a trading name of Sara Stewart, a sole trader operating in the United Kingdom.

These Terms & Conditions govern the provision of website design, Managed Hosting & Care and related services. By engaging our services, you agree to these terms.

2. Website packages and pricing

We offer the following website design packages at the prices stated below. All prices are in pounds sterling. The published prices are the amounts payable, with no additional VAT currently charged.

The Tadpole — £350 (one-off design fee) The Leap — £595 (one-off design fee) The Big Splash — £895 (one-off design fee)

The website design fee is a one-off charge for the design and build of your website. It does not include ongoing hosting, maintenance or support, which are provided separately under a Managed Hosting & Care plan.

We reserve the right to update our prices. Any price change will be communicated in advance and will not affect work already agreed and in progress.

3. Payment terms

A deposit of 50% of the agreed website design fee is required before website development begins. Work will not commence until the deposit has been received.

The remaining 50% is payable once you have reviewed and fully approved your completed website and it is ready to go live. Publication of your website may be withheld until final payment has been received in full.

Managed Hosting & Care charges are billed separately, as described in Section 4.

All invoices are payable within the timeframe stated on the invoice. Where legally applicable, we reserve the right to charge statutory interest on overdue amounts in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

4. Managed Hosting & Care

All website packages require a Managed Hosting & Care plan. Hosting & Care is charged separately from the website design fee and is required for a minimum initial term of 12 months, beginning on the date your website is first published.

Monthly charges are as follows:

  • The Tadpole Care — £30 per month (for single-page websites)
  • The Leap Care — £45 per month (for four-page websites)
  • The Big Splash Care — £60 per month (for six-page websites)

After the initial 12-month term, your Hosting & Care plan continues on a rolling monthly basis until cancelled in accordance with Section 5.

Each plan includes managed website hosting, routine technical upkeep within our hosting platform, email support for website-related issues, and a monthly allowance of minor content updates as specified in your chosen Hosting & Care package. Unused allowances do not roll over.

New pages, redesigns, additional functionality and more extensive changes are not included and will be quoted separately.

5. Cancellation of Hosting & Care

After the initial 12-month Hosting & Care term, you may cancel your rolling monthly plan by giving 30 days' written notice to hello@thepondjumper.com.

Cancellation during the initial 12-month term is subject to the terms of your individual agreement and applicable law. Nothing in these terms removes or limits any statutory rights you may have.

On cancellation, your website will remain live until the end of the notice period, after which hosting will cease. We will provide reasonable assistance to help you retrieve your content before that date. If you wish to transfer your website to another hosting provider, you should arrange this before your hosting service ends. Please be aware that a transfer may involve a period of temporary downtime. Nothing in these terms removes or limits any statutory rights you may have.

6. Website ownership

Once the website design fee has been paid in full, you own your original content and the agreed website design deliverables, subject to any third-party licensing restrictions and the platform restrictions described below.

The underlying website-building technology used to create and host your website is proprietary to its provider and remains the property of that provider. This technology is not transferable to unrelated hosting platforms.

You retain ownership of your domain name or names. We will not register, hold or control your domain on your behalf unless separately agreed in writing.

7. Website transfers

After the initial 12-month Hosting & Care period, you may request a supported transfer of your website to another compatible GoDaddy account.

One standard supported transfer is included without an additional administration fee, provided all outstanding payments have been settled at the time of the request.

Transfers to unrelated hosting platforms may require a complete website rebuild because of the proprietary nature of the underlying technology. We are not responsible for the cost of any such rebuild.

Following a completed transfer, The Pond Jumper is no longer responsible for hosting, maintenance, security or ongoing website care.

8. Client responsibilities

To enable us to deliver your website on time and to the agreed standard, you agree to:

  • Provide all required content, materials, images and information promptly and in the format requested.
  • Ensure that any content, images or materials you supply do not infringe the intellectual property rights of any third party.
  • Review and approve or request changes to work within the agreed timeframes.
  • Respond to communications in a timely manner.
  • Ensure that any information you provide about your business, services or products is accurate and not misleading.

Delays caused by late or incomplete provision of content or approvals may affect the project timeline. We will not be responsible for delays arising from your failure to meet these responsibilities.

9. Revisions

Each website package includes a revision allowance as stated in the agreed package description or quotation. A round of revisions means one consolidated set of changes submitted at one time.

Revisions beyond the included allowance, or changes that represent a significant departure from the original brief, will be quoted and charged separately at our standard hourly rate.

Revisions must be requested before final approval and publication of the website.

10. Timescales

We will provide an estimated project timeline at the outset of each project. Timescales are estimates and are not guaranteed unless expressly agreed in writing.

Timescales depend on the prompt provision of content, materials and approvals by you. We will not be responsible for delays caused by late or incomplete client input.

If we anticipate a significant delay on our part, we will notify you as soon as reasonably practicable.

11. Third-party services

Some services we offer may involve the use of third-party platforms, tools or services, including but not limited to Google Business Profile, booking systems and social media platforms.

Third-party services are subject to their own terms and conditions, pricing and availability. We are not responsible for any changes, interruptions or discontinuation of third-party services.

Any third-party subscription fees or charges are your responsibility and are not included in our prices unless expressly stated.

12. Liability

We will carry out our services with reasonable care and skill. However, we do not guarantee that your website will achieve any particular commercial outcome, search ranking or level of traffic.

Subject to the paragraph below, our liability to you in connection with any services provided under these terms is limited to the fullest extent permitted by law.

Nothing in these Terms & Conditions excludes or limits any liability that cannot lawfully be excluded or limited.

We are not liable for any loss or damage arising from your failure to provide accurate information, your use of third-party services, or events outside our reasonable control.

13. Intellectual property

All design work, copy and other materials created by us remain our intellectual property until the website design fee has been paid in full.

You warrant that any content, images or materials you supply to us are either owned by you or that you have the necessary rights and permissions to use them, and that their use will not infringe any third-party rights.

We may include a discreet credit on your website and reference your project in our portfolio, unless you ask us not to.

14. Changes to these terms

We may update these Terms & Conditions from time to time to reflect changes in our services, technology, business practices or legal requirements.

The current version will always be published on this website with its effective date. Updated terms apply to new agreements entered into after the effective date of the update. Existing contracts continue to be governed by the terms agreed at the time, unless any changes are validly agreed between the parties or are otherwise lawfully implemented.

For ongoing services, we will give reasonable notice of any material changes.

15. Governing law

These Terms & Conditions are governed by the laws of England and Wales.

Subject to any mandatory statutory protections or jurisdiction rights that apply to you, any disputes arising from or in connection with these terms shall be subject to the jurisdiction of the courts of England and Wales.

Nothing in these terms affects your statutory rights as a consumer, where applicable.
